Also, Part 97 explicitly allows CW practice, bulletin and telemetry transmissions.  At least my 2000 version does.

Since the dawn of time, well, radio at least, in the FCC's view, "Broadcasting" has a special, rather specific meaning.  Think AM, FM or TV broadcasting - truly one way to the _general public_.  Hams "transmit" bulletins, etc. - things that can be viewed as being one way, but still aren't _broadcasting_ - to other hams and a special subset of the general population.
