That radio is an unlicensed "ISM" radio in the United States. While
that ISM band does overlap the 70cm band, it is not at all clear from
the FCC rules what the limits are on communication between ISM devices
and licensed ones.
The message will have to include a call sign if its use is not clearly
ISM.
I would also be a little concerned that the protocol does not seem to
be "public" (and decipherable by other users), thus limiting its use in
ham applications.
